Metaverse is a symbiosis of the virtual and real world that allows users to communicate, work and even do business completely digitally and interactively. The potential for companies is enormous. New business models can emerge and existing ones can be expanded. The lecture presented the current developments and challenges in the metaverse and provided insights into the industries that could be particularly affected. Opportunities and risks were highlighted and initial ideas outlined.

INSIGHTS INTO THE RESTRUCTURING OF EUROPE'S LEADING BEAUTY RETAILER

The stationary retail trade is fighting for acceptance. The growing importance of e-commerce is changing consumers' shopping behavior and is the driving force behind the change. Products such as books, electronic items or entertainment media are increasingly being purchased online. Shopping in a store must become an experience. Good ideas for the transformation are needed.
Presented were how a future-proof concept was developed for a beauty retailer's branch network. A new branch structure and the development of an online platform were implemented operationally.

SUSTAINABILITY AS A RELEVANT DYNAMO: HOW LEGAL REQUIREMENTS AND STAKEHOLDER INTERESTS INFLUENCE COMPANIES

More and more companies will be pushed into reporting by both legal requirements and their stakeholders such as investors, banks, customers and employees. If the criteria are not met, the reputation and thus the competitiveness of the company will suffer. Equity financing will become more difficult. Banks will grant loans at less favorable conditions, customers will prefer to buy sustainable products and services. Employees, in turn, are increasingly demanding employers who actually take ESG and, in particular, sustainability seriously.

Sustainability in investments is on everyone's lips today due to ESG, GreenDeal and the EU taxonomy. What does this mean in practice and what are the specific implications for medium-sized companies? What trade-off do we see as a result of changed financing criteria and their operational implementation? “Investing in a Net Zero Business Model” are our guidelines today, which have to be implemented as quite a hurdle in the operational business. How the transformation to sustainable corporate management can look like

WHAT IS THE APPROPRIATE USE AND MISUSE OF INSOLVENCY PROCEEDINGS?

The US is once again leading the way. But there are already constellations in Germany and Austria where the local model could find imitators here. This necessitates answering fundamental questions. So, vibrant companies use insolvency proceedings to free themselves from product liability. Is this the much-vaunted “fresh At what point does the usage of insolvency proceedings become abusive, or when does the need for legal protection disappear?

IS AUSTRIA A PARADISE FOR CORPORATE RESTRUCTURING FROM A LABOR LAW PERSPECTIVE?

Lawmakers in Austria have made use of the option to exclude the transfer of undertakings from insolvency proceedings. Provided certain requirements are met, complicated constructions are not necessary when transferring undertakings in the event of insolvency. The bundling of employee interests in creditor protection associations and the tighter management of insolvency proceedings make the Austrian approach to labor law appear more advantageous than in Germany.

A strategic approach to restructuring in difficult times

Update of the economic assessment in Germany and Austria

Over the past two years, cost inflation has hit companies in Europe as hard as the lockdowns imposed in the wake of the COVID-19 pandemic. In many industries, this is compounded by disruptive changes in markets and technologies, as well as by rising regulatory requirements, such as ESG. We found that rising raw material and energy prices are still a key issue. What is new is not only the massive increase in the cost of raising capital, but also the more restrictive lending practices in the financial sector. There is much more precise selection by industry.

EMOTIONAL SKILLS IN INSOLVENCY PROCEEDINGS

In a negotiation situation or even in insolvency proceedings, there must be a result at the end. Trust is important, but so is knowing your own role, the roles of your teammates, and how to assess the other side. We discussed how we can emotionally adjust to the negotiation situation in addition to having good factual arguments and positions. We had an exciting and entertaining discussion with our guest, Martin Hörmann.

HOW TO INNOVATE IN THE MIDST OF A CRISIS

Quo vadis hotel industry: rising construction costs, interest rates, inflation, digitalization and EU taxonomy. Rebranding and refurbishments using a copy-paste procedure are a thing of the past. Concepts and locations need to be rethought. The discussion revolved around how existing hotels can now hold their own in a dynamic market environment and what requirements are placed on owners, operators and banks.
